I Eli Phillips of the town of Nestorville, County of Barbour and State of West Virginia, make this
my last will and testament hereby revoking all former wills by me made, and direct the payment of
all my just debts.
I give device (sic) and bequeath to Mary E. Phillips my wife, all my real estate also my personal
property that I own at my death. The real estate being the land bought from Ramon (??) Stemple,
and adjoining the lands of H.B. & J.I. Kelley and B.L. Nestor.
I appoint J.I.Kelley my Executor of this my Will.
Witness my signature this the 7th day of December, 1914.

Signed published and declared by Eli Phillips as and for his last will and testament in the presence
of us who in his presence at his request and in the presence of one another have hereunto
subscribed our names as witnesses.

The State of West Virginia,
Barbour County Court Clerk's Office, December 28, 1914
The last Will of Eli Phillips, Deceased, was this day presented in said office for probate by J.I.
Kelley, the Executor therein named and the same having been proved before the Clerk of this
Court by the oath of H.B. Kelley and R.M. Nestor, the two subscribing witnesses thereto, the
same was admitted to probate and ordered to be recorded and a record thereof was made
accordingly.
The widow of the said decedent having waived her right to administer upon the estate of
her late husband, therefore upon her motion, J.I. Kelley, is hereby appointed as Executor of the
said Will and Testament of the said decedent and thereupon he together with H.B. Kelley as and
for his surety entered into and acknowledged a bond in the penalty of One Hundred (100.00)
Dollars, conditioned according to law and took the oath prescribed by law as such Executor.
