I, Joseph Phillips of the County of Barbour and State of Virginia, do hereby make my last will
and testament in the manner and form following that is to say:
(1) - I desire that my son Obadiah Phillips have the farm on which I now live on in the County of
Barbour adjoining lands belonging to Wm. Ramsey, Jacob Bennett and others; and that the said
Obadiah Phillips have all my personal property, consisting of livestock, farming utensils, tools of
various kinds household and kitchen furniture too (sic) beds and bedding and one side saddle
excepted which I my wife Mary Phillips to have to dispose of as she may see fit, all except that
which I have excepted to belong to my son Obadiah on condition that he the said Obadiah Phillips
after my decease pay all my just debts and on further condition that the said Obadiah shall
comfortably maintain my wife Mary Phillips during her natural life.
(2) - I wish my daughter Zipporah , now wife of Ambrose Hymes to have one hundred acres of
land where they now are living to run with the line of James Long and thence to run with land
formerly claimed by John Cross and to be run in such form as to include there (sic) house and
spring. The said Zipporah to have and to hold the said land during her natural life and at hur (sic)
decease to belong to the heirs of hur (sic) body, the said land I have purchased of Wm. F.
Deacons and hold his title bond for the same.
(3) - My will is that my son Obadiah and my daughter Mary Ann now wife of Jacob Phillips have
the balance of the above named tract of land, which I purchased of the said Deacons to be equally
divided between them, to belong to my daughter Mary Ann and the heirs of hur (sic) body.
(4) - I give to my son Simeon Phillips one dollar.
(5) - I give to my grandson Gilbert Hymes 5 dollars.
And lastly I do hereby constitute and appoint my son Obadiah Phillips Executor of this my last
will and testament.
In witness whereof I have hereunto set my hand and seal this 2nd day of December 1854.

Signed, sealed published and declared by Joseph Phillips as for his last will & testament in the
presence and hearing of us who at his request and in his presence have subscribed our names as
Virginia: Barbour County Court April Term, 1855
The last will and testament of Joseph Phillips deceased was this day presented in Court
and proved by the oaths of Jacob Bennett and Laban Bennett, subscribing witnesses thereto and is
ordered to be recorded.
