Will dated 19 May 1911





I, Franklin E. Payne, of Elk District  Barbour County, State of West Virginia, do make and publish this my last Will
and Testament as follows, hereby revoking any and all former Wills heretofore made by me that is to say

FIRST: I give and bequeath to my daughter Emma Payne, Hudkins, all my household and kitchen furniture of every kind and
character and  also all my farming implements of every kind and character such as wagons, mowing machines, harnesses and such.
I also give and bequest to her my gold watch and chain.

SECOND: I will and bequeath to my grandson Benjamin Payne and my granddaughter Martha Payne children of my son Benjamin now
deceased, One Hundred Dollars ($100.00) each to be paid to them out of my personal estates, by my executer as aforesaid.

THIRD: I will and bequeath to my son Andrew J. Payne, Four hundred dollars ($400.00) to be paid to him out of personal estates
by my executor as aforesaid.

FOURTH: I will and bequeath to my son John B., Payne, Two hundred dollars ($200.00) to be paid to him out of my personal
estates, by my executor as aforesaid.

FIFTH: I will and bequeath to my son Lewis A. Payne two hundred dollars $200.00) to be paid to him out of my personal estates,
by my executor as aforesaid.

SIXTH: I will and bequeath to my son Richard F. Payne two hundred dollars ($200.00) to be paid to him out of my personal
estates, by my executor as aforesaid.

SEVENTH: After the payment of the foregoing bequests and all my debts and personal expenses, which said debts, if any and
personal expenses I direct to be paid, the payment of the bequests hereinfore provided for, then all the rest of my estates
whatever king or character, and whatsoever situate, I direct that it shall be converted unto cash by my executer hereinafter
named and the proceeds be divided equally among my five children now living and the children of my son Benjamin, that is
to say the two children of my son Benjamin are to receive one-sixth part of any such residue of my estate that their
father would have received if he were living at the time of my death:

EIGHT: I nominate and appoint my son Richard F. Payne Executor of this my last Will and Testament.
