     I, Diana M. Despard, of Clarksburg, W.Va., being in health and of sound mind, do hereby declare this to be my last will and testatment. I declare that $500.00 be given to the Episcopal Church of Clarksburg, W.Va. To my God Daughter Elizabeth Leavell I wish given $100.00. I desire that my brother Burton M. Despard should have $2000.00, and to my brother Duncan Lee Despard, I leave the residue of all of my estate, both real and personal, wherever, situated, and all money owing me at the time of my death. I appoint and request my friend Mr. James M. Ambler, to act as executor of my estate.

Signed, sealed, published as and for her last will and testament by the above named, in the presence of us, who at her request in her presence and in the presence of each other both hereunto subscribed our names as witnesses:

STATE OF WEST VIRGINIA
In the office of the Clerk of the County Court of Harrison County. In vacation December 31" 1906.
John J. Davis, this day presented to the clerk of said Court a paper writing purporting to be the last will and testament of Diana M. Despard, deceased, and offered the same for probate. Thereupon came Geo. L. Duncan, S. R. Harrison and B. M. Despard, who after being duly sworn, depose an say that they are well acquainted with the hand writing of said Diana M. Despard, deceased, and that the paper purporting to be her last will and testament is, they verily believe, wholly in her own hand writing and the signature thereto in her own genius signature; and that at the date at of said writing said testator was of sound mind and memory and over twenty-one years of age. The said will being thus fully proved is admitted to probate and ordered to be recorded and filed as directed by law.

STATE OF WEST VIRGINIA COUNTY OF HARRISON, TO-WIT:- I, W. Guy Tetrick, Clerk of the County Court of Harrison County, State of West Virginia, do hereby certify that the foregoing and annexed instrument is a true copy of the last will and testament, and probate thereto of Diana M. Despard, late of Harrison County, West Virginia, deceased, duly filed and proved in the County Court of said County and State, and admitted to probate therein on the 31st day of December 1906, the same being recorded in Will Book number 8, page 347, in the office of the Clerl of the County Court aforesaid. In Testimony Whereof, I have hereunto set my hand and affixed the seal of said Court, this 25th day of March 1907.

Bassell, President of County Court, of Harrison County, State of West Virginia, the same being a Court of Record and having a seal, do hereby certify that W. Guy Tetrick, is Clerk of the County Court, for the County aforesaid, that the foregoing attestation of his, as Clerk aforesaid is in due form of law and by the proper officer, and that all due faith and credit is and ought to be given to his attestation as Clerk aforesaid.
