Will of Mary Burch -

Names: Polly Newbanks, Ezekiel Burch, Covington Burch, Elizabeth Ann Burch,
Lavina Burch, Betsy Ann Burch, Nancy Rutman, Braxton Tharp, John Evans of Peter
and Polly Evans David VanMeter-Christina Evans and Charles A. Brown.

I, Mary Birch of the County of Hardy and State of Virginia do hereby publish
and declare this to be my last will and testament in manner and form following
That is to say- First, I desire that my just debts and funeral expenses be paid by
my Executor hereinafter named - 2nd I leave to Polly Newbanks fifty dollars -3rd:
After the above is paid I wish my money or notes I may have coming to me to be
equally divided  between Ezekiel Birch, Covington Birch, John Evans of Peter,
Nancy Rutman (formerly Nancy Tharp) and Braxton Tharp. 4th: I give to Elizabeth
Ann Birch my bed and bedding as it stands, also my trunk. 5th: The little furniture
I may have left about my house I wish equally divided between Lavina Birch, Betsy
Ann Birch, Polly Evans & Nancy Rutman. 6th: Should Ezekiel Birch continue to keep
me during my life time I then direct that he shall have one hundred dollars over
and above his equal share of my money and notes above mentioned. Should he
however not continue to keep me as above mentioned then I direct that my
executor pay to those that do keep me one hundred dollars. Lastly I constitute
David Vanmeter Executor to this my last Will and Testament. In Testimony
whereof I have hereunto set my hand and seal this 21st day of February in the
year of our Lord 1853. Mary (X her mark) Birch. Witnesses: Christiny Evans and
Charles A. Brown.

At a court held for Hardy County the 4th day of July 1853, This last will and
testament of Mary Birch, dec'd was proven by the oaths of Christeeny Evans and
Charles A. Brown subscribing witnesses thereto and ordered to be recorded. And
on the motion of David Vanmeter the executor therein named who made oath
according to law certificate is granted him for obtaining a probate thereof in due
form on giving bond and security whereupon he with security entered into and
acknowledged bond conditioned as the law directs. Teste: Jas. Gamble C.H.C.
