This will is from Hampshire County, WV, WB12, p. 331, but most of the names of Elizabeth Tharp's heirs were living in Hardy County, WV.

The date Elizabeth Tharp's will was written is without a doubt 1843! The date it was presented in court appears to be 1843. [Sage & Jones Early Records of Hampshire County VA now WV, shows 1863, which is in error!]


The Will of Elizabeth Tharp:

In the name of God, Amen, I Elizabeth Tharp of the county of
Hampshire and state of Virginia, being weak in body but of sound
and perfect mind and memory, blessed be Almighty God for the
same, do make and publish my last will and testament in manner
and form following, that is to say, First I will and bequeath to
the heirs of John Tharp, Jun., Dec'd, namely Elizabeth Ann, Mary
Brogdon and Nancy [Tharp] the sum of $35 to be equally divided
among them, to be paid by my executor as they severally arrive at
the age of 21 years.

I also will and bequeath to the children of Anna Evans, Dec'd
(late Anna Tharp) namely John, Emily, William, Rhoda and Jemima,
the sum of $35 to be equally divided among them [at age 21, etc.
as above].

I also will and bequeath to my daughter Elizabeth Tharp the sum
of $40 to be paid to her out of my effects by my executor as soon
as possible after my decease.

[Elizabeth Tharp held a note on her son Isaac Tharp for the
sum of $76.75 and she gave this to him as his share.]

After the above legacies were paid, then from the remainder of
her estate, daughter Elizabeth and her son Solomon were to each
receive $76.75, then the residue of the estate was to be divided
equally between her children namely Isaac Tharp, Elizabeth Tharp
and Solomon Tharp.

Elizabeth Tharp repeated in her will that her daughter
Elizabeth was to receive her $40 plus $76.75 for a total of
$116.75, and then she was to receive a 1/3 share of the remainder
of the estate.

"I hereby appoint my son Solomon Tharp as my sole executor of
this my last will and testament hereby revoking all former wills
by me made. In witness whereof I hereby set my hand and seal this
24th day of June in the year of our Lord Eighteen hundred
and forty three."

The witnessess were Bennett Bean, James Davidson and Joseph
Tucker. On 28 August 1843, James Davidson and Joseph Tucker
appeared in court to prove her will. Samuel C. Ruckman and Thomas
Ruckman were the bondsmen for Solomon Tharp in the amount of
$1000. Solomon was issued a Certificate of Probate on 28 August
1843.
