Division of the land of Jacob Willis, Senior, deceased, Hardy County September Court, 1860

Pursuant to an order of the County Court of Hardy County a copy of which is hereto annexed, we the subscribers as [abbreviated word -- commissioners?] to divide the land of Jac. Willis Sen. decd. have proceeded to discharge the duty impowered upon us & by leave to submit the following report which is represented by the diagram viz.

we assign to Abraham Willis lotts 1 & 2 by an inclusive boundary as follows. Beginning at a white oak at (1) an original corner of the old Shepherd tract & with a line thereof N64-W32 poles to a corner in said line leaving the original lines & crossing the knobs N30-E196 poles to a corner at (B) where the line between 6 & 7 will intersect and with a line of No.7 - N17-E56 poles to (C) a corner in a line of the original & with the original lines S16-E150 poles to two sugars and a hickory on a divide of the mt. (cut away) S17-W86 poles to a bunch of [lyuses?] in a hollow on the west side of the mt. at (8) S81-W160 poles to the beginning containing 115_ acres more or less being equal to 2/7 of whole property.

We assign to John Willis lotts 3 & 4 in an inclusive boundary. viz: Beginning at (A) a corner to A. Willis in the original(abb) line & with the later(sic) N64-W18 poles to 2 hickories in a gap N75-W77 poles to a large white oak on Seymour's line (cut away). & with it N17-E76 poles crossing spring drain to a stone on the S. side of a hill at (D) corner to No.5 & with the division line S84-E120 poles to (E) a corner in A Willis line. & with it S30-W101 poles to the Beginning, containing 56_ acres more or less being equal to 2/7 of the whole and reserving & excepting the privelege of a watering place for the owner or occupyer (sic) of No.1 & 2 lote or any parts thereof & at such times only as is actually necessary & the owner or occupyer of No.1 & 2 when necessary to use such water priveleges is to prepare the same in such a manner as not to molest the Spring or Dairy on No.3 & 4 --

No.5 we asign to Archibald Cornell & the heirs of his decd. wife Rebecca & is bounded as follows. Viz: Beginning at a stone corner to John Willis at (D) & with his line S84-E120 poles to (E) a corner in A.Willis line & with it N30-E25 poles to (G) a corner to No.6 & with a line thereof N74-W123 poles to a stone at (F) in Chalyliate Spring hollow in Seymour's line on the S. side of a drain with same S17-W45 poles to the Beginning containing 25_ acres more or less being equal to 1/7 of the whole.

Lott No.6- We assign to the heirs of Jacob Willis Jun. Decd. or to the legal representatives of Mary Kessel Decd. & is bounded as follows. Viz: Beginning at (F) a stone in Chalyliate hollow corner to No.5 & with a line thereof S140-E123 poles to (G) in A Willis line and with it N30-E68 poles to (B) a corner to said WIllis & lot No.7 & with the latter N83-W140 poles to a stone at (H) in Seymours line and with it S77-W44 poles to the Beginning. containing 44_ acres more or less being equal to 1/7 of the whole.

We assign lot 7 to Jacob Willis Jun. decd. & is Bounded as follows. Viz Beginning at a white oak at No.(4) by a drain corner to Seymour & with his line S17-W42 poles to a stone corner to No 6 at (H) & with a line thereof S83-E140 poles to A Willis corner at (B) & with his line N17-E56 poles to (C) in a line of the original & with it N16-W176 poles to two Black oaks corner to McNeill & Cunningham & with is(his?) line of the latter S11-E180 poles to his corner in a deep hollow at (5) & with his line again N83-W127 poles to the Beginning containing 48 acres more or less being one seventh of the whole.

We also lay off and assign to the widow of Jacob Willis Jun. decd. as her full dower in lot No.1 - embracing(?) the (?ings) and Bounded as follows. Viz: Beginning at a white oak by a drain No.(4) corner to Seymour & with his line S17-W42 poes to a stone a[t] (H) with the division line S83-E19 poles to a stone at (I) N17-E42 poles to a stake in Cunningham's line at (K) & with it N83-W19 poles to the beginning containing 4_ acres. also the privelege of getting timber for rails(?) & firewood for the use of said dower off of No.7.

We also lay off to the widow of Jacob Willis Jr.,Decd. as he [the?] dower in No.6 which is bounded as follows Beginning at a stone in Seymour's line at (H) & with a line of the lot S83-E19 poles to a stone same course continued 10 poles further to a stone at (L) on the E. side of a drain. S4-W50 poles to a line of No.5 at (M) & with the same N74-W39 poles to a stone in Chalyliate hollow on the south side of a drain at (F) in Lyon[?] line & with the same N17-E44 poles to the Beginning containing 121 acres.

The owners or occupyers of either of the lots or part thereof herein assigned are to have the rights, ingress or egress at any and all such times as necessity may require - The share of Jac. Willis Jun. Decd. is not susceptible of division. All of which is respectfully submitted

Hardy County to wit
Upon motion of Arch Cornell, Sanford Y. Simmons, Thom Stingley & Joseph McNemar 3rd are appointed commisioners to make partition of the lands of which Jacob Willis Decd. died seized so as to assign to Jacob Willis now (dead?). 2/7 to Arch. Cornell & wife 1/7. to Ab Willis 2/7 to Jn Willis 2/7 also to assign to the widow of Jacob Willis Jnr. Decd. and that they further make partition of the share allotted to said Jacob Willis Junr. so as to allot to James Willis 1/6 thereof. to Ab Willis 1/6 to Arch Cornell & wife 1/6 to James Wilson and wife 1/6 to Jane Trenton sole heir of Catherine Trenton late Willis 1/6 and to the heirs of Isaac Kessel & wife late Willis 1/6 thereof and make report to the court of their action
