This deed made this 21st day of April 1859 between PHILIP McNEAMER of the one part and WILLLIAM McNEAMER of the other part of the county of Lewis and the state of Virginia. Witnesseth that for the consideration of one dollar in hand paid and one hundred and fifty dollars to be paid to ISAAC B. McNEMAR, JOSEPH McNEMAR, and PHILIP McNEMAR Jr children of the Grantor herein in five annual installments of thirty dollars each the first of which is to be advanced one year from the decease of the said P. McNEMAR Sr. the said PHILIP McNEMAR doth grant unto the said WILLIAM McNEMAR all the following described tract or parcel of land, lying in Halls Run a tributary of Big Skin Creek in the county and State aforesaid adjoining land of JOHN CORATHERS and others, the same being the upper end of the farm now owned by the said PHILIP McNEMAR Sr. and what remains thereof over and above what is included in the deed executed to JOHN B. McNEMAR bearing equal date with this instrument , and bounded as follows toWit, Beginning at the Hickory and Poplar on the top of the ridge, on the West side of said run which are more partickularly [sic] designated in the deed to said J.B. McNEMAR thence to a small walnut corner of said JOHN B. McNEMAR thence with said J.B. McNEMARS [sic] line to be [un...] to the requirements of his deed to one of the boundary line on the east side of said run, then with said boundary to the beginning so as to include all the land which has been conveyed to said JOHN B. McNEMAR containing One hundred acres be the same more or less. It is especially understood that the Grantor is to retain the possession of the above described tract of land and is to have the Management and control thereof during his natural lifetime. Philip McNemers [sic] last will & Testament
Know all men by these presence that I PHILIP McNEMAR of the County of Lewis and State of Virginia being of sound and disposing mind and memory do make and publish this my last will and testament. First I give and bequeath my personal property what is herein after mentioned and disposed of to my six daughters MARY HELMICK, MARGARET MORISON, ELIZABETH SMITH, NANCY McNEMAR, JULIAN McNEMAR and SARAH WILSON and desire that it be sold at public auction on a credit of twelve months and the proceeds of the sale divided equally among my several daughters above named. Second, I give and bequeath to my daughter NANCY McNEMAR in addition to what I have already given her one coverlet, and also one to my daughter JULIAN McNEMAR.
Third, I have already given to my son WILLIAM McNEMAR for the consideration of the sum of one hundred and fifty one dollars and my maintenance during my natural lifetime One hundred acres of land lying on Halls Run a branch of Big Skin Creek in the County of Lewis in the State aforesaid. I also bequeath to him my bed and bedding.
Forth, I have already given to my son JOHN B. McNEMAR sixty acres of land adjoining the tract I have given to my son WILLIAM and conveyed it to him for the same consideration, except for my maintenance.
Fifth, I have already given to my sons ISAAC B. McNEMAR, JOSEPH McNEMAR and PHILIP McNEMAR one hundred dollars each to be paid by my sons WILLIAM and JOHN B. McNEMAR in the manner specified in their deeds which I have executed to them for the tracts of land refered [sic] to. But if it is necessary if anything in addition should be given then in order to render this will legal, I hereby give and devise to each of the [missing word] as well as my son JOHN B. McNEMAR [missing word] minimum sum as may make this instrument valid and forceful.
Sixth, I ordain and appoint GEORGE I. MARSH as executor of this my last will and testament.
In testimony whereof I have here unto set my hand and seal, and publish and declare this to be my last will and testament in the presence of the witnesses named below, this 21st day of April 1859.

At a court held for the County of Lewis at the court house [sic] thereof, on Monday, January the 14th 1861.
The last will and testament of PHILIP McNEMAR decd. was this day presented in open court and partly proven by the oaths of JACOB BOTT one of the subscribing witnesses thereto, and continued for further proof.
And at another time towit: on the 15th day of January 1861, The last will and Testament of PHILIP McNEMAR decd. was this day again presented in open court, and fully proven by the oath of H. M. PETERSON another subscribing witness to said will and ordered to be recorded.
Thereupon GEORGE I. MARSH the executor named in said will came into open court who made oath and together with GEORGE W. CURTIS his security entered into and acknowledged bond in the penalty of one thousand dollars [missing word]...as the law directs. Certificate is granted him for obtaining a probate on said will in due form.
On motion of the said GEORGE I. MARSH it is ordered that JACOB BOTT, GEORGE W. CURTIS and ANTHONY R. SPAUR, after being duly sworn for that purpose, do truly and justly appraise in currant [sic] money the estate of the deceased, and return their appraisement under their hands to this court.
