Robert & Mary Dougherty to Mathew Marsh - March 30th 1860

Marshall County Deed Book 13, page 396, 30 Mar 1860

     This Deed, made The 30th day of March in the year of our Lord one thousand eight hundred and sixty between Robert Dougherty and Mary his wife of the first part and Mathew Marsh of the second part. Witness eth: That in consideration of the sum of nine hundred dollars, the receipt of which is hereby acknowledged, the said parties of the first part doth grant unto the said party of the second part the following described property, that is to say a certain tract or parcel of land situated on Whetzelís Run adjoining land of Wm Dougherty, James Campbell and others and bounded as follows (to wit) Beginning at a White Walnut stump corner to Niel McNaughten. Thence N 25? E 59 ps to a stake Thence N 62Ĺ? W149 ps to a stake in James Campbellís line Thence S 7? W 59 ps to a stake corner to Niel McNaughten Thence with his line S 62? E 126 poles to the beginning. Containing fifty acres more or less and being the same land conveyed by Wm. Dougherty and wife to said Robert Dougherty by deed bearing date April first 1853

     And the said Robert Dougherty and Mary his wife doth herby covenant with the said party of the second part that they will warrant personally the property herby conveyed.

State of Virginia, County of Marshall To Wit:
     I James Buchanan a Justice of the peace for the county aforesaid in the state of Virginia, do certify that Robert Dougherty whose name is signed to the deed hereto annexed, bearing date on the 30th day of March 1860, has acknowledged the same before me in my county aforesaid. Given under my hand this 30th day of March eighteen hundred and sixty.

State of Virginia, County of Marshall To Wit:
     We James Buchanan and A. R. Kimmins Justice of the peace for the county of Marshall in the state of Virginia, do certify the Mary Dougherty the wife of Robert Dougherty whose name is signed to the deed hereto annexed, bearing the date on the 30th day of March 1860 personally appeared before us in the county aforesaid, and being examined by us privately and apart from her husband, and having the deed aforesaid fully explained to her. She the said Mary Dougherty acknowledged the said deed to be her act and declared that she had willingly executed the same and does not wish to retract it.

Given under our hands this 30th day of March eighteen hundred and sixty.

     This deed from Robert Dougherty and wife to Mathew Marsh was this day and in my office for record and being duly certified by two justices of the peace, the said deed and certificate are admitted to record.
