I, James McHenry of the County Marshall, State of Virginia, in the name of God, do hereby declare this to be my last will and testamony of my real and personal estate. My real estate I will to three of my sons in the following manner, To James, my son, i will twenty four acres of land on which he now lives, the same that was surveyed to him by Thomas Tucker with the understanding that he is to pay my Executor the sum of three hundred dollars as follows, one hundred dollars six months after my death and the death of my wife, Rebecca McHenry, the remainder in eighteen months after our decease. To my son, Joseph mcHenry, I will thirty acres of land on which he now lives, the same that was surveyed to him by Thomas Tucker with the understanding that he is to pay my executor the sum of two hundred and fifty dollars as follows, one hundred dollars in six months after my death and the death of my wife, Rebecca McHenry, the remainder in eighteen months after our decease. To my son, John McHenry I will thirty six acres of land on which he now lives, the same that was surveyed to him by Thomas Tucker with the understanding that he is to pay my Executor the sum of three hundred dollars as follows, one hundred dollar in six months after my death and the death of my wife, Rebecca McHenry, the remainder in eighteen months after our decease. i will to my daughters Isabelah Burch, Rachel Reed, Rebecca Lowery and Ann McHenry one dollar each to be paid to them by my Executor in six months of my death and the death of my wife, Rebecca McHenry. To my daughter, Ruth Burch, I will one hundred dollars to be paid to her by my Executor in eighteen months after my death and the death of my wife, Rebecca McHenry. To my son, Robert McHenry, I will two hundred dollars to be paid by my Executor in eighteen months after my death and the death of my wife, Rebecca McHenry. To my daughter, Melvina Cooper, I will three hundred dollars to be paid by my Executor in eighteen months after my death and the death of my wife, Rebecca McHenry. To my daughter Elizabeth Booth, I will two hundred dollars to be paid out by my Executor for the aid of her and her heirs in eighteen months after my death and the death of my wife, Rebecca McHenry. To Edward McHenry, son of Robert McHenry, I will fifth dollars to be paid to him by my Executor in eighteen months after my death and the death 9f my wife, Rebecca McHenry My personal property after my death and the death of my wife, Rebecca McHenry and all lawfully expenses defrayed, the remainder money is left to be divided equally among my heirs. My real estate I will to my wife, Rebecca McHenry (should she outlive me) during her natural life to hold as her own. And lastly, I do hereby constitute and appoint George W. McKimmie, Executor of this my last will and testament hereby revoking all other wills or testaments by me made in writing whereof I have herewith set my hand and affixed my seal the 26th day of February 1857.

The last will and testament of James McHenry, dec., was this day proved by the oaths of John F. V. Kelly and William A. Kelly, the subscribing witnesses thereto, and is ordered to be recorded and leaves given Geo. W. McKimmie the person named the Executor of said will, to qualify at the next term.
