Will of David Jones

David Jones Will

In the name of God Amen, I David Jones of East Town in Chester county being aged but of sound disposing mind and memory calling to mind that it is appointed for all men to die do constitute appoint and ordain this as my last will and testament as follows,

Imprimis I commend my soul to the Lord Jesus Christ who hath redeemed me from wrath to come, and dispose of all my worldly goods as follows,

First it is my will that all my just debts and funeral expenses be paid with all convenient speed and a marble Tomb Stone be placed over my grave in the great valley near my deceased wife,

Item whereas I have conveyed large Tracts of land to my son Morgan Jones near Ohio which I deem a just proportion of all my property excepting that may be hereafter mentioned, to my said son I give all my wearing apparel,

Item whereas I have conveyed the farm on which I now live to my son Horatis Gates Jones I deem it the full proportion of my estate and I do hereby confirm the same unto him his heirs and assigns forever I do also give unto him my Bamboo cane--

Item to my son Horatis Gates Jones I give in trust for the use of my daughter Eleanor formerly the wife of John Garrett deceased the one half of all my remaining estate consisting in land bills and bonds and goods not otherwise disposed of and it is my will that my said son shall pay to my said daughter or to her children such sums of money as she may require at any times three years after my decease and her reeipt shall be a discharge for the same or should she be dead the receipt of her children shall shall be sufficient.

Item to my grandson Joseph McClean and to his heirs and assigns forever I give and bequeath one hundred and fifty acres of land being part of a tract of land conveyed to me by Thomas Church situate in the eighth district of the Pennsylvania donation land.

Item to my grand son Horatis Jones McClean and to his heirs and assigns forever I give and bequeath three hundred acres of land being in my donation tract situate in the eighth district of the Pennsylvania donation situate on the waters of Broken Straw also to my said grand son I give my silver watch.

Item to my grand son Elisha Garrett and to his heirs and assigns forever I give and bequeath one hundred and fifty acres of land situate in the Pennsylvania donation in the eighth district lying on the waters of Broken Straw the west end, the east end is given to my grand son Joseph McClean.

Item to my grand son David Jones son of Morgan Jones and to his heirs and assigns forever I give and bequeath one hundred and sixty five acres of land situate on the waters Licking in Licking county and Ohio state being the south end of a tract of land conveyed to me by Thomas Church and about four miles from New Ark incumbering said tract with the following reservation (viz) should his father Morgan Jones stand in need of it he shall have the priviledge to live on it during his natural life, .. Item to my grand son Elisha Garrett and to his heirs and assigns forever I give and bequeath one hundred and fifty acres of land being the North End of the above mentioned tract situate on the waters of Licking in Ohio state.

Item to my grand daughter Ann Jones daughter of my son Morgan Jones I give and bequeath thirty dollars to be kept in the hand of my son Horatis Gates Jones and paid to said Ann Jones after she arrives to the age of eighteen.

Item to my grand daughter Mary Jones the daughter of my son Morgan Jones and her heirs and assigns forever I give and bequeaththe sum of one thousand dollars to be kept in the hand of son Horatis Gates Jones to be paid unto said Mary Jones at such times and in such sums as he think proper and expedient and I give also to the said Mary Jones the bed on which the girls now sleep one boulster two pillows and two pillow cases two sheets two blankets and one coverlid.

Item to my grand daughter Elizabeth Jones now living with me and to her heirs and assigns forever I give and bequeath one thousand dollars to be kept in the hands of my son Horatis Gates Jones and paid unto said Elizabeth Jones at such time and in such sums as he may deem proper and I give also to my said grand daughter Elizabeth one bed in which Hannah McClean used to sleep one boulster two pillows and and two pillow cases two sheets two blankets and one coverlid and it is my will also that the two legacies last mentioned of one thousand dollars each be put out on interest and I allow my son Horatis one tenth part of the interest and I allow my son Horatis one tenth part of the interest as a compensation for his trouble.

Item to my daughter Eleanor formerly the wife of John Garrett deceased and to her heirs and assigns forever I give and bequeath my best bed in the big room four sheets four blankets one boulster four pillows and four pillow cases two coverlids one bed quilt my best set of curtains with all the appurtenances also to my said daughter I give the one half of all my table cloaths and one half of all my towels and silver plate.

Item to my grand daughter Mary Ann McClean and to her and her heirs and assigns forever the bed on which I sleep four blankets four sheets a coverlid and cotton quilt a set of curtains with the appurtenances thereunto belonging one boulster four pillow and four pillow cases also one half of all my table cloaths and one half of all my towel and one half of all my silver plate.

Item to my good old trusty friends Gaven Murchie I give and bequeath one hundred acres of land to him his heirs and assigns forever situate in Knox county Wayne Township on the waters of Owl Creek he now having the possession of it but no deed yet executed also I give him the bed on which he sleeps and bed cloaths.

Item whereas I have large quantities of lands in Wood county state of Virginia it is my will that my executor hereafter named make sale thereof within three years after my decease.

Item I will that all my estate not otherwise disposed of be equally divided between my daughter Eleanor including her children and the three children of my daughter Mary deceased namely Joseph Horatis Jones McClean and Mary Ann McClean.

Lastly I do herby constitute ordain and appoint my son Horatis Gates Jones sole Executor of this my last will and testament, I do herby give unto my said Executor full power to convey lands make titles and confirm contracts and do hereby ratify and confirm whatsoever My Executor shall legally do in discharge of his duty and for his compensation I allow him eight hundred dollars confirming this as myl last will and testament, In witness whereof I have hereunto set my hand this twenty second day of June Anno Domini 1818.

West Chester March 3d 1820 Then personally appeared William Walley & Henry Walley who being solemnly sworn according to law did depose & say that they were personally present & did see & hear David Jones the Testator in the foregoing instrument of writing named sign seal publish pronounce and declare the same as and for his last will and testament and that at the doing thereof he was of a sound and well disposing mind and memory to the best of their knowledge and belief .
