Will of Maria Kleiner 1895

In the name of God, Amen, I, Maria Kleiner of 
the County of Marshall and State of West Vir-
ginia being of sound mind and memory
(blessed be Almighty God for the same) do
make and publish this my last Will and
Testament. I give and bequeath to my son
David Kleiner of the City of Wheeling State afore-
said the South one half of the North half of Lot
numbered Seventy-eight (S 1/2 of the N 1/2 Lot No. 78) on
the East Side of Main Street, between twenty-
first and twenty Second Streets (formerly, Alley
B. and third Street) in the fifth ward of the City
of Wheeling aforesaid together with all the im-
provements thereon, [being?] the same property con-
veyed to me by John Ramsey and wife, by Deed bear-
ing date on the 24th day of March 1879, which
said Deed is duly recorded in Deed Book No. 68
Page 658, in the County Court Clerk's Office of
Ohio County West Virginia. The foregoing bequest
is made Subject to the payment of a debt of
one thousand dollars ($1000.00/100) due [Catharine
Devine?] of the City of Wheeling, for which said
sum of money the said [Catharine Devine?] holds
my note, signed by me and my husband Chris-
tian D. Kleiner, the payment of said note being
secured by a Deed of Trust on the property hereby
bequeathed (executed by myself and my said hus-
band). The payment of the aforesaid debt of ($1000.00/100)
is hereby made a charge on the foregoing bequest.
It being my will that my son David shall pay
said debt of $1000.00/100.

I nominate and appoint my beloved husband
                               last
Christian D. Kleiner Executor of this my Will and
Testament.

In testimony thereof, I hereunto set my hand
and seal and publish and declare this to be my
last will and testament in the presence of the
witnesses named below this 14th day of December 1894.

Signed, dealed, and declared and published by the
said Maria Kleiner, as and for her last Will and
testament in the presence of us who, at her request
                               and in the
and in her presence and in her  presence of each
other, have subscribed our names as witnesses hereto

West Virginia Marshall County Court,
Clerk's Office, Feby 14th 1895.

A paper writing bearing date of Dec. 14th 1894,
and purporting to be the last Will and Testament
of Marie Kleiner, deceased, late of this county is
this day fully proved before me upon the oaths
of James [?] McGill and David [?] F[ortz] the two sub-
scribing witnesses thereto and is admitted to pro-
bate and ordered to be recorded as and for the
true last Will and Testament of the said Marie
                          Executor
Kleiner, deceased, and Christian D. Kleiner [?]
in said Will named, is granted leave to qualify
as such Executor at some future day.
