Will of Thomas McCreary

In the name of God amen: I THOMAS MCCREARY of the county of Marshall and
State of West Virginia knowing the uncertainty of this life and the
certainty of death, and being of sound mind and disposing memory do make
and publish this my last will and testament hereby revoking all former
wills by me made.

Item 1st  I direct that all my just debts and funeral expenses be paid out
of my personal estate.

Item 2nd  I hereby give and bequeath to my beloved wife HANNAH all my
personal property after paying debts and funeral expenses including all
moneys notes bonds stock on the farm, household and kitchen furniture,
farming utencels grain. Hay and that may remain on the farm at my death
to have and to hold and enjoy during her natural life and what may remain
at her death to go to my son ELLIS MCCREARY.

Item 3rd  I hereby give bequeath and devise to my son ELLIS the following
portion of my home farm to wit:  All the land on the East Side of the
following line including my House and other buildings reserving however
to my beloved wife HANNAH a life estate in the same at her death then to
go to my son ELLIS as follows to wit: Commensing at a Stake 27 poles South
East from the (?) and near the (barn?).thence in a Southerly direction and
along the fence to what is known as the Cawfield line thence on a South East
direction with the Cawfield line to a  drains Part and near to the Sheep
shed or house thence down that drain to its mouth at the Big Run thence up
the Big Run to the fallen breech comer, but my son ELLIS is to pay to my
daughter SIDNEY CALDWELL six hundred dollars and to pay to the heirs of my
son ISAAC MCCREARY, decd. Twenty five Dollars these legacies are to be a him
upon the sand devised to my son ELLIS and I direct them to be paid by him as
follows to wit: in four equal annual payments for the time of my death but
without any interest on any of the payments until they become due.

Item 4th  I hereby give bequeath and devise to my son THOMAS J. MCCREARY all
the lands on the west of the line above named but direct that he shall pay to
my daughter SIDNEY CALDWELL four hundred dollars and that he shall pay to my
duaghter MARY DAGUE Four hundred Dollars these legacies I have as a lien on
the land devised to my son THOMAS to be paid by him in four equal payments
for the time of my decease. But without any interest on any of the payments
until they become due.

Item 5th.  I give and bequeath to the heirs of my son ISAAC MCCREARY decd the
sum of twenty five to be paid by my son ELLIS as above directed.  I have
heretofore given and advanced to my son ISAAC in his life time full share and
portion of my estate and this is the reason that I give only twenty five
Dollars to his children.  

Item 6th  I hereby give and bequeath to my daughter SIDNEY CALDWELL the sum
of one thousand dollars to be paid as above directed to wit: Six hundred dollars
by my son ELLIS out of the real estate willed to him and four hundred Dollars
to be paid by my son THOMAS J. out of the real estate willed to him.

Item 7th  I hereby give and bequeath to my daughter MARY DAGUE the sum of one
thousand Dollars to be paid as above directed to wit: Six hundred dollars to
be paid by my son ELLIS out of the real estate willed to him and four hundred
dollars to be paid by my son THOMAS J. out of the real estate willed to him.

Item 8th  I so hereby nominate and appoint THOMAS J and ELLIS MCCREARY to be
the executors of this my last will and testament.  In witnesses whereof I have
hereunto set my hand and seal this 12th day of January in the year 1874.

The within will of THOMAS MCCREARY was signed and sealed and delivered by him
to be his last will and testament in our presence and at his request we have
witnessed the same and signed our names hereto at this request and in the
presence of said THOMAS MCCREARY and in the presence of each other as witness
our signatures this 12th day of January 1874

West Virginia Clerks office Marshall County Court April 5th 1890

A paper writing bearing date on the 12th day of January 1874 purporting to
be the last will and testament of THOMAS MCCREARY late of this county Deceased
was this day fully proved before me in my office by the oaths of J.L.
PARKINSON & G.S. MCFADDEN the subsen being witnesses thereto and is ordered
to be recorded and leave is given the executor therein named to some future
day to qualify as such.
