Will of Payton Trussell

To all whom it may concern: Know ye that I Payton Trussell of Dallas, Marshall County, W. Va. being of sound and disposing mind and impressed with the uncertainty of this mortal life do make this my last will and testament viz: 1st - I will that all my just debts (funeral expenses included) shall be paid. 2nd - I will that my beloved wife Martha shall have of my estate a competence sufficient for her maintenance including all necessary expenses. Also that all my household and kitchen furniture shall be at her disposal if she shall survive me. 3rd - I will that all my property real and personal not included above shall be sold and the proceeds equally divided share and share alike among my eight children. C. F. Trussell, J. R. Trussell, J. R. Trussell, S. M. Trussell, Siney J. Wallace, Sarah A. Hart, Nancy E. White, and Mary M. Howard. 4th - I appoint my two sons, J. R. Trussell and S. M. Trussell and my son in law James Howard my executors with all authority to carry out the provisions of this my last will and testament. In testimony of the above, the testator hath hereunto set his hand and seal this 16th day of March A.D. 1881.

A paper writing bearing date on the 16th day of March 1881 proporting to be the last will and testament of Payton Trussell late of this county decd. was this day fully proved by the oaths of S. S. McDaid, J. R. Trussell the subscribing witnesses thereto in open court + is ordered to be recorded + J. R. Trussell, S. M. Trussell + James Howard the executors therein named who made oath thereto + together with James Thompson their security who testified as to his sufficiency entered into + acknowledged their bond in the ______ sum of Eight thousand dollars conditional and payable as the law directs. Thereupon certificate is granted the said J. R. Trussell, S. M. Trussell + James Howard for obtaining a probate of said will in due form + it is ordered that John Trussell, James Thompson, + S. S. McDaid be they are appointed appraisers of the Estate of the said Payton Trussell, dec'd, they being first duly sworn for that purpose.
