James Jefferson Will

I James Jefferson of Marshall County and State of Virginia do make and ordain
this my last will and testament in manner and form following to wit:  After the
payment of all my just debts and funeral expenses out of my out door personal 
property I give and bequeath to my beloved wife all my household and kitchen 
furniture with every couvenances pertaining thereto to dispose of as she sees
proper.
2nd  I give and bequeath to my son Jacob Jefferson Eighty two acres of land of
my home farm.  Deeded to me by David McClure the said Jacob is to have the South 
End of the farm Beginning as the plot will show at a beech corner in Stephen
Freeland's line running East a chestnut in David Rumble's line between me and 
the widow Roberts the said Jacob shall survey and write these lines and the
line between me and John Taylor and across from line to line so as to give him
my homested with all its improvements to him and his heirs forever in which 
his mother shall hold her ?     when she shall choose.
3rd  The remainder of my farm is one hundred acres.  I give and bequeath 
to my 2 sons John and James to be equally divided between them.  Fifty Acres
each the said James is to have the improved part on which he now lives to them
and their heirs forever by paying to my daughter Elizabeth or her heirs wife of
William Wilson Five Hundred Dollars of which James shall pay three hundred
Dollars and John Two Hundred to be paid in three years yearly with no interest
thereon.
4th  I give and bequeath unto my son Stephen Jefferson my farm on the Roberts
Ridge Road One Hundred and 9 acres more or less and at the head of the Round 
Bottom Run Deeded to my Father by David McClure and Deeded to me by the heirs 
of my Father to him and his heirs forever and the said Stephen in consideration 
there of shall pay to my two daughters or their heirs  

1st Isabelle wife of Henry Holmes and Nancy wife of William Lutes. Five Hundred
Dollars to each of them makeing one thousand Dollars to be paid yearly in such 
payments as he shall be able to make and he shall have six years to pay the
herein named sum if he can't pay sooner there shall be no interest or usuary
demanded of him under any circomstances.
And lastly I appoint my brother Jacob Jefferson sole Executer of this my 
last will and testament hereby revoking all other wills and appointments
heretofore by me made.  In testimony whereof I have hereunto set my hand Seal
this this twentieth day of November in the year of our Lord one Thousand
Eighty hundred and Sixty three.

West Virginia Marshall County Court January Term Jan 21st, 1875
A paper writing bearing date November 20th 1863 purporting to be the last will
& testament of James Jefferson Sr Dec was this day fully proved in open court
by the oaths of Joseph M Reader & Anthony Hollingshead two of the subscribing
witnesses thereto & ordered to be recorded.  Jacob Jefferson the executor
therein named here in open court declares to accept said trust & on the motion
of the said Jacob Jefferson
John Jefferson is appointed administrator with said will annexed who took the
oath as required by law & togather with John P Workman his security who
Qualified as to his sufficiancy
Entered into & acknowledged their bond in the penalty of $500 conditioned &
payable as the law directs certificate is granted the said John Jefferson for
obtaining a probate of said will in due form And it is ordered that Richard
Allen, J M Reader & Anthony Hollingshead be are appointed appraisors of the
said estate they being first duly sworn for that
purpose.
