Following is from a land deed book in Hampshire county, West Virginia and is
on pages 175 and 176 of an unknown book.
This Indenture made and entered this into this 24th day of May 1845 between
Daniel Whip of the first part and Sarah Whip widow of William Whip deceased
and Betsy Ann Whip, William H. Whip, Lucretia Catharine Whip, Eliza Jane Whip,
Mary Susan Whip, Simon Peter Whip and Sanford Whip children and heirs of said
William Whip deceased of the second part. Whereas the said Daniel Whip and
Catharine his wife on the 12th of August 1829 by deed of record in this county
court of Hampshire in deed book No. 27 page 108 did convey to the said William
Whip his heirs and afsigns a certain tract of land lying on or near Beaver Run
containing 141 1/7 acres for a more particular description of (?) references
(?) made to said deed upon the condition neverthelefs that the said William
Whip should tend the said (forson?) in a form and like manner during the life
time of the said Daniel Whip and his wife Catharine and to give them one full
third part of the crops of every thing which may be raised on the said farm
the priviledge of the land and garden to be mutually and equally between them
the said Daniel Whip and his wife Catharine and at their death the said
William is to pay to each of his brothers and sisters just so much as he the
said William may deem just and equitable he the said William to be the sole
judge And whereas the said Daniel Whip is willing and desiring to confirm and
convey to the said parties of the second part the said tract of land free of
every sort of condition or encumbrances and of releasing them from every
obligation imposed upon them by reason of said deed or of any thing contained
in it. Now therefore this Indenture witnefsith that for and in consideration
of the sum of one dollar to him in hand paid before the sealing and delivery
of the deed the (?) whereof is hereby acknowledged he the said Daniel Whip for
himself & his heirs and afsigns hath given granted bargained sold and
confirmed to the said parties of the second part and their heirs and afsigns
the said tract of land free from any condition or encumbrance whatsoever and
the said Daniel Whip for himself & his heirs and afsigns doth hereby exempt
acquit and release the said parties of the second part from every obligation
of every sort imposed on them or and of them by the deed aforesaid or imposed
upon the said William Whip deceased and also from every liability incurred by
the said parties of the second part or any of them by reason of any breach of
condition or of any obligations contained in the said deed. And the said
parties of the second do hereby for themselves their heirs and afsigns
covenant and agree to and with the said party of the first part that they will
support him in ease and comfortable during his life time. In testimony whereof

above written.

Be it remembered that on the 24th day of June 1845 This Indenture was
presented in the Clerk's Office, proved as to all the parties by the
affirmation of Daniel Clark a witnefs thereto and as to all the parties except
Eliza Jane Whip, by the affirmation of Solomon Arnold another witnefs thereto,
and at another day to wit the 12th day of July 1845. The same was fully proved
as to all the parties by the affirmation of Nicholas Bizer another witnefs
thereto and admitted to record.
