Will of Ralph Smith Senr.
I, Ralph Smith Senr. of the County of Tyler and State of West
Virginia being
of sound mind and disposing memory, do make my Last Will and
Testament in manner and form following that is to say I give and
bequeath to my son Charles W. Smith the farm on which I now live
containing 190 a. with it's appurtenances together with all my
personal property of every description and kind, upon condition
however that he takes care of and maintains my wife, Margaret
Smith, during her natural life, in a comfortable manner, shall
pay all my just debts and funeral expenses and the bequest
hereinafter made which I hereby make charges upon my said real
and personal property. I give and bequeath to my daughter Nancy
K. Ash, the wife of Daniel W. Ash, Three hundred and forty six
dollars to be paid by my son Charles W. Smith within five years
from the date of my death without interest, but should my son
fail to pay the said sum at that time then the said sum of $346.
shall bear interest. I hereby appoint my son Charles W. Smith
and my son-in-law Daniel W. Ash executors of this my Last Will
and Testament herby revoking all other or former wills by me
heretofore made.
In Witness whereof I hereunto set my hand and seal this 7th
day of July 1867.

Recorders office of Tyler County, August 18th, 1869
A paper writing purporting to be the Last Will and Testament
of Ralph Smith Senr., deceased, having been presented in the
Recorders office for probate on the 13th day of August, 1869 by
Charles W. Smith, one of the Executors named therein and process
having been issued, directed to the Sheriff of Tyler County,
requiring him to summon every person interested in said probate,
to appear here on this present day to show cause why the said
Will should not be admitted to record and the said summons
having been returned duly executed and no person appearing to
show cause against the said Will, the execution thereof by the
said Ralph Smith Senr. was duly process by the oaths of Kenner
S. Smith and Delilah Williamson subscribing witnesses thereto
whereupon said Will was admitted to record as and for the Last
Will and Testament of the said Ralph Smith Senr., deceased.
