Will of Thornton James Buck--1913
Will submitted by David Gillespie Buck, grandson of Thornton J.
Buck. From: Tyler County Wills, Volume 5, pages 130,131 & 132
I, T.J.Buck, of Tyler County, W. Va. do hereby make and publish
this my last will and Testament hereby revoking all former Wills
by me at any time heretofore made and executed by me.
1st:- I will and direct that all my just debts and funeral
expenses be paid by my Executrix hereinafter named as soon after
my decease as may be practicable.
2nd:- To my daughter Loma Z. Bowers I give, devise and bequeath
to her the sum of Eight Hundred dollars in money to be paid to
her by her four brothrs as follows, at my death five hundred
dollars and at the death of my wife and the mother of Loma the
further sum of three hundred dollars and I make this bequest a
lien on my real estate hereinafter mentioned and devised to my
sons, until the said eight hundred dollars is paid as aforesaid.
3rd- I give, in addition to the other bequests hereinafter set
forth to my son Delta D. Buck one, 1 year old colt and to
J.H.Buck, my son, one 2 year old colt.
4th- Having hereto-fore given to my son Onward Buck the sume of
thirteen hundred dollars and having given my son Luster F Buck
the sum of one thousand dollars as an advancement, it is my wish
and desire to make my four sons equal in the division of my
estate, therefore I devise and bequeath and will to my son
Luster F. Buck $300; and to my two sons John H. and Delta D. the
sum of thirteen hundred dollars each, which sums will make them
equal with the amount I have given and advanced to my son
Onward; then, after making my sons equal and after my four sons
pay to their sister the $800 hereinbefore set forth in item 2 of
this my last will I direct, devise, and bequeath to my said four
sons after being made equal as aforesaid all the rest, residue
and remainder of my estate both, real, personal and mixed share
and share alike after being made equal as set forth in this
will. If I do not die possessed of sufficient money to pay my
sons and daughter the sums devised to them as hereinbefore set
forth then it is my will that out of the proceeds of the sale of
my real estate, before any division is made of the proceeds from
the sale, that my daughter Loma Z. Bowers be paid $800, Luster
F. my son $300, and my two sons Delta D. and John H. $1300 each.
If I have enough cash on hand at my death to pay these legacies
then it is my wish and I so devise and request my executrix to
pay said sums of money to my said three named sons and daughter
as aforesaid out of my personal estate, otherwise to pay them
out of my real estate and after being made equal to divide the
rest, residue and remainder of my estate between my said four
sons share and share alike so that they will all receive an
equal sum of money.
5th- I make these bequests all subject to my wife Maggie E.
Bucks dower interest in my estate; I also nominate and appoint
my wife Maggie E. Executrix of this my last will and testament
and request and desire that she be allowed to qualify and
administer my extate without giving any bond.
In testimony whereof I have hereunto set my hand and affixed my
seal to this my last will and testament typewritten on two
sheets of paper this the Sixteenth day of July A.D. 1913.

Signed, sealed, and published and declared by the said T.J.Buck,
as and for his last will and Testament, in the presence of us
who, at his request and in his presence, and in the presence of
each other, have subscribed our names as witnesses thereto.
